Terms of Service

Notice: This English version is provided as a working draft and is pending review by US/Canada legal counsel. The Portuguese version (limaopay.com.br/termos) is the authoritative document for users in Brazil. By using LimaoPay in the United States or Canada, you acknowledge this notice.
1. Service Definition
LimaoPay is a SaaS (Software-as-a-Service) platform that enables creators and small businesses to build conversion-optimized sales pages using AI-generated content. LimaoPay is not a payment gateway, marketplace, or drag-and-drop website editor. We provide a sales-acceleration engine integrated with third-party payment providers (Stripe, etc).
2. Account & Eligibility
You must be at least 18 years old to use LimaoPay as a seller. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into binding contracts.
Authentication is done via Magic Link (emailed link), Google OAuth, or email + password. You are responsible for keeping your credentials and the email associated with your account secure. Each account is associated with a Tenant (organization) that owns all resources created on the platform.
Tax ID requirement: Sellers in the United States must provide a valid SSN or EIN; sellers in Canada must provide a valid SIN or Business Number. Each Tax ID may be linked to a single account. Multiple-account creation using the same Tax ID will be rejected. LimaoPay may suspend accounts with identification irregularities.
3. Pricing & Plans
LimaoPay offers the following plans for users in the United States and Canada:
- Free — $0/month. Unlimited pages. 8% transaction fee.
- Growth — $9.90/month ($95/year). 3% transaction fee. Unlimited AI Turbo Mode, AI copy generator (100/month).
- Scale — $29.90/month ($287/year). 1% transaction fee. Unlimited AI features, priority support.
Transaction fees are deducted from each sale processed through the platform. Stripe processing fees apply separately and are charged by Stripe. The minimum order amount is $5 USD.
Subscription fees are charged in advance on a recurring basis. You may cancel your subscription at any time, and the cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period unless required by applicable law.
4. Sales Tax
Sellers are responsible for determining, collecting, and remitting any sales taxes, VAT, GST, or other taxes applicable to their sales, including but not limited to state and local taxes in the United States and provincial taxes in Canada. LimaoPay does not provide tax advice and does not collect or remit sales tax on your behalf unless specifically enabled via Stripe Tax integration.
5. Payouts
Payouts to sellers are processed via Stripe Connect using Direct Charges. Stripe handles all payment processing, including chargebacks and disputes. Funds are held for a minimum of 30 days after the sale before becoming available for payout, to mitigate chargeback and fraud risk during the dispute window. After this period, payouts follow Stripe's standard payout schedule.
Stripe assumes responsibility for negative balances arising from chargebacks under its Direct Charges model. Sellers are responsible for monitoring their Stripe account, completing KYC requirements, and providing accurate banking information for payouts.
6. Refunds & Disputes
Refund policies are set by individual sellers, who are responsible for clearly disclosing them on their sales pages. LimaoPay enables sellers to issue refunds via the dashboard, processed through Stripe. Chargebacks initiated by buyers through their card issuer are handled according to Stripe's dispute resolution process; sellers are responsible for providing evidence to contest disputes within the required timeframes.
7. Acceptable Use & Prohibited Content
You agree not to use LimaoPay to sell, distribute, or promote:
- Illegal goods or services under federal, state, or provincial law
- Firearms, ammunition, explosives, or weapons of any kind
- Cannabis, controlled substances, or drug paraphernalia
- Adult content, including pornography or escort services
- Counterfeit goods, intellectual property infringement, or pirated materials
- Multi-level marketing schemes or pyramid scams
- Financial products requiring licensing (e.g., investment advice, insurance, lending) without proper authorization
- Hateful, discriminatory, or violent content as determined by LimaoPay at its sole discretion
- Any content that violates third-party rights or applicable law
LimaoPay reserves the right to suspend or terminate accounts that violate these restrictions, with or without prior notice.
8. Intellectual Property & DMCA
Sellers retain ownership of all content they create or upload to the platform. By using LimaoPay, you grant us a non-exclusive, worldwide license to host, display, and process your content as needed to provide the service.
DMCA notices: If you believe content on LimaoPay infringes your copyright, send a written notice to dmca@limaopay.com including: (a) identification of the copyrighted work; (b) the URL where the infringing content appears; (c) your contact information; (d) a statement made under penalty of perjury that the information is accurate and you are authorized to act on behalf of the rights holder.
9. AI-Generated Content
LimaoPay uses third-party AI providers (DeepSeek, Google Gemini, OpenAI) to generate page copy. AI-generated content is provided as-is. You are responsible for reviewing and editing all AI output before publishing, including verifying accuracy of claims, compliance with advertising standards (FTC truth-in-advertising rules in the US), and compliance with applicable laws.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIMAOPAY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO LIMAOPAY IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR SPECIFIC SALES OUTCOMES.
12. Termination
You may terminate your account at any time by canceling your subscription and contacting support. We may suspend or terminate your account for violations of these Terms, prolonged inactivity, or as required by law. Upon termination, your access to the platform ceases, but data retention follows our Privacy Policy.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be announced via in-app notification or email at least 30 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws applicable in the jurisdiction where LimaoPay's operating entity is registered, without regard to conflict-of-laws principles.
Any disputes shall first be addressed through good-faith negotiation between the parties. If unresolved, disputes shall be settled through binding arbitration in accordance with the rules of a recognized arbitration body. You waive your right to participate in class actions, except where such waiver is unenforceable under applicable law.
